These Terms and Conditions apply to your use of Funda.nz (“Funda”, “we”, “us”, “our”), an online platform operated by Service Saver (“Service Saver”, “Company”). Funda connects community groups running fundraisers with local business partners offering promotions.

By accessing or using Funda.nz, creating an account, or claiming a promotion through a fundraiser page, you agree to these Terms.

If you do not agree, please do not use Funda.nz.

1. Key definitions

  • Platform means Funda.nz.
  • Community Group means a school, sports club, charity, or community organisation running a fundraiser on Funda.
  • Business Partner means the local business offering a promotion through Funda.
  • Supporter means a person who claims a promotion through a fundraiser on Funda.
  • Promotion means the offer provided by a Business Partner that a Supporter claims via a fundraiser page. Promotions may also be referred to as vouchers or certificates in communications.
  • Campaign means the fundraising period for a Community Group on Funda.

2. What Funda does

Funda provides a platform to:

  • host fundraiser pages for Community Groups,
  • process payments from Supporters,
  • issue promotion confirmations to Supporters,
  • track campaign totals and provide reporting, and
  • coordinate payouts to Community Groups and Business Partners in line with each campaign’s agreed terms.

Funda is not the Business Partner and does not provide the underlying services. The Business Partner is solely responsible for delivering its services and honouring the Promotion, subject to the Promotion terms.

3. Eligibility and accounts

You must be at least 18 years old to use Funda.nz. If you are acting on behalf of a Community Group or Business Partner, you confirm you have authority to do so.

We may require verification before approving partner accounts. We may refuse, suspend, or cancel access if we reasonably believe an account is being misused or information provided is inaccurate.

4. Campaign and promotion information

Each campaign page will display key details, which may include:

  • campaign dates,
  • the Business Partner involved,
  • promotion details and any key conditions,
  • the fundraising share per promotion claimed (or how the fundraising share is calculated),
  • any claim limits or caps, and
  • payout timing.

It is the Supporter’s responsibility to read the campaign and promotion information before claiming.

5. Promotions and redemption

5.1 Promotions are provided by Business Partners

Business Partners set the Promotion terms, including availability, booking requirements, exclusions, and expiry.

5.2 Redemption

Supporters redeem Promotions directly with the Business Partner in accordance with the Promotion terms. Supporters must follow the instructions provided in their confirmation email and on the campaign page.

5.3 Booking and service delivery

All booking, scheduling, and service delivery is handled by the Business Partner. Funda is not responsible for the Business Partner’s services, workmanship, availability, or business operations.

6. Payments, fees, and splits

When a Supporter claims a Promotion, the payment is processed through the Platform.

Each successful claim is split into:

  • a Community Group share (fundraising payout),
  • a Business Partner share, and
  • a Platform share (to cover platform operation, payment processing, reporting, support, and campaign administration).

The exact split may vary by campaign and will be shown on the campaign page or agreed in the partner terms.

7. Payouts

7.1 Community Group payouts

Unless stated otherwise on the campaign page, Community Group payouts are made after the campaign closes, subject to any required verification and the refund/chargeback provisions in these Terms.

7.2 Business Partner payouts

Business Partner payouts are made in line with the campaign agreement and payout schedule.

7.3 Reporting

Funda may provide weekly reporting during campaigns and a final summary report after campaign close.

7.4 Delays

Payouts may be delayed due to payment processor holds, fraud checks, chargebacks, incorrect payout details provided by a partner, or other events outside our reasonable control.

8. Refunds, cancellations, and chargebacks

8.1 Cool-off period (Supporter refunds)

We offer a 7-day cool-off period from the time you claim/purchase a promotion from the website. If you change your mind during this period, you can request a refund as long as:

  • the promotion has not been redeemed, and
  • the campaign is still within the cool-off window, and
  • the funds from your purchase have not been paid out to the Community Group and Business Partner.

Once funds have been paid out (in full or in part), we cannot provide a refund because the purchase forms part of a fundraising payout.

Approved refunds may be subject to an administration fee of $20 to cover payment processing costs.

8.2 How to request a refund

To request a refund, contact us at support@funda.nz with your name, email address, and order reference.

8.3 Chargebacks and payment disputes

If you initiate a chargeback or payment dispute, we may pause any related payouts and access to the Platform while the dispute is being reviewed.

9. Campaign changes and caps

Campaigns may have caps and may be run in batches to manage Business Partner capacity. Funda may pause, extend, or stop a campaign where needed for fairness, safety, or operational reasons, including suspected misuse or inaccurate information.

If a campaign is paused or stopped, we will take reasonable steps to communicate this on the campaign page and to affected partners.

10. Acceptable use

You agree not to:

  • misuse the Platform or attempt unauthorised access,
  • submit false information,
  • harass, mislead, or impersonate others,
  • interfere with the Platform’s operation, or
  • use the Platform in a way that breaches New Zealand law.

11. Intellectual property

All content and materials on Funda.nz, including branding, website design, and content, are owned by or licensed to Service Saver unless stated otherwise.

Community Groups and Business Partners retain ownership of their own trademarks and brand assets they provide. By providing content to Funda, you grant us a licence to use it for running and promoting your campaign on the Platform.

12. Privacy

Our collection and use of personal information is explained in our Privacy Policy. By using the Platform, you agree to our handling of personal information as set out there.

13. Disclaimers

To the extent permitted by law:

  • Funda provides the Platform “as is”.
  • We do not guarantee uninterrupted access, and we may perform maintenance or updates.
  • We are not responsible for the quality, safety, or outcomes of Business Partner services.
  • Promotion value statements are based on information provided by Business Partners and may be subject to conditions and exclusions.

Nothing in these Terms limits any rights you may have under the Consumer Guarantees Act 1993 or the Fair Trading Act 1986, where applicable.

14. Limitation of liability

To the maximum extent permitted by law, Service Saver and Funda will not be liable for:

  • indirect or consequential loss,
  • loss of profit, revenue, or opportunity,
  • issues arising from Business Partner service delivery,
  • third-party platform outages (including payment processors), or
  • misuse of the Platform.

If we are liable to you for any reason, our total liability is limited to the amount paid by you to Funda for the relevant Promotion claim (or $[amount], whichever is lower), unless the law requires otherwise.

15. Termination

We may suspend or terminate access to the Platform where we reasonably believe there has been a breach of these Terms, misuse, or unlawful activity.

You may stop using the Platform at any time.

16. Changes to these Terms

We may update these Terms from time to time. The current version will be posted on Funda.nz with the updated date. Continued use of the Platform after changes means you accept the updated Terms.

17. Governing law

These Terms are governed by the laws of New Zealand, and any disputes will be subject to the non-exclusive jurisdiction of the New Zealand courts.
